These Terms of Service ("Terms") govern your use of motorsconfidence.my and the services offered on it by Motors Confidence ("we", "us", "our"). By accessing the website, creating an account or listing a vehicle, you agree to these Terms. If you do not agree, please do not use the website.
1. Who can use the website
You must be at least 18 years old and legally able to enter into contracts under Malaysian law to create an account, list a vehicle or buy a vehicle through the website.
2. What we provide
Motors Confidence is an online marketplace where sellers list used vehicles and buyers contact sellers directly by WhatsApp or phone. Unless we expressly state otherwise for a particular listing:
- we do not own, sell or inspect the vehicles listed by sellers;
- any sale is a contract between the buyer and the seller only, and we are not a party to it; and
- we do not process payments for vehicle purchases through the website.
Tools such as the loan calculator and the estimated monthly instalments shown on listings are for illustration only. They are not financing offers, and actual terms are decided by the lender.
3. Your account
- Give accurate information when you register and keep it up to date.
- Keep your password confidential. You are responsible for everything done through your account.
- Tell us promptly if you believe your account has been used without your permission.
- Seller access is granted at our discretion and may be withdrawn at any time.
4. Rules for sellers
When you list a vehicle, you confirm that:
- you own the vehicle or are authorised to sell it;
- the listing is accurate and complete, including the mileage, condition, accident and flood history, and any outstanding hire-purchase loan or other encumbrance;
- you have the right to use every photo you upload; and
- you will mark the vehicle as sold, or remove the listing, once it is no longer available.
Listings are reviewed before they are published, but approval does not mean we have verified the vehicle or the information in the listing. We may reject, edit, suspend or remove any listing at our discretion. Listing a vehicle is currently free of charge. We will tell you before introducing any fee.
5. Self-reported information and trust indicators
Battery state of health, range and similar figures are reported by the seller from the vehicle's own system and are not independently verified by us. The Confidence Trust Score, verification badges and seller ratings are indicators to help you compare listings. They are not a guarantee of a vehicle's condition, history or value.
6. Advice for buyers
Before you pay any deposit or purchase price, you are responsible for satisfying yourself about the vehicle and the seller. We strongly recommend that you inspect the vehicle in person, check ownership and history records with JPJ, obtain an independent inspection, and confirm that any outstanding loan will be settled.
7. Escrow and add-on services
Escrow, financing, insurance, inspection and related services are optional. They are arranged only when the buyer and seller both request them, and are subject to the fees, terms and partner requirements agreed with you at the time. Where those service terms conflict with these Terms, the service terms apply to that service.
8. Reviews
- Reviews must be honest and based on your genuine experience with the seller.
- You may leave one review per seller, and sellers may not review themselves.
- Do not post content that is false, defamatory, abusive, discriminatory or that reveals someone else's personal information.
We may remove any review that breaks these rules or that has been reported and found to be inappropriate.
9. Things you must not do
- Post false, misleading or fraudulent listings, or list stolen vehicles or vehicles you are not entitled to sell.
- Use the website to scam, harass or spam other users, or to collect their personal data.
- Copy, scrape or republish listings or other content from the website without our permission.
- Interfere with the security or operation of the website, or try to access accounts or systems you are not authorised to use.
- Break any applicable law.
10. Content and intellectual property
You keep ownership of the content you upload. By uploading it, you give us a non-exclusive, royalty-free licence to host, display, reproduce and adapt it for the purpose of operating and promoting the website. All other content on the website, including our name, logo and design, belongs to us or our licensors and may not be used without our permission.
11. Third-party services
The website links to services run by others, such as WhatsApp, banks and insurers. We are not responsible for their content, products or practices, and your use of them is governed by their own terms.
12. Disclaimer
The website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we make no warranty that the website will be uninterrupted or error-free, or that any listing, review or other content is accurate or complete.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for any loss or damage arising from a transaction between buyers and sellers, from your reliance on any listing, review or self-reported information, or from any indirect or consequential loss. Nothing in these Terms excludes or limits any liability, or any right you have as a consumer, that cannot be excluded or limited under Malaysian law.
14. Indemnity
You agree to compensate us for any claim, loss or expense, including reasonable legal fees, arising from your listings, your reviews, your breach of these Terms or your violation of any law or third-party right.
15. Suspension and termination
We may suspend or close your account, or remove your content, if you breach these Terms or if we reasonably believe your use of the website harms other users or us. You may stop using the website and delete your account at any time from your profile page.
16. Personal data
Our Privacy Policy explains how we collect and use your personal data.
17. Changes to these Terms
We may update these Terms from time to time. The "last updated" date at the top of this page shows when they were last changed. Continuing to use the website after a change means you accept the updated Terms.
18. Governing law
These Terms are governed by the laws of Malaysia, and any dispute will be subject to the jurisdiction of the courts of Malaysia.
